1.2 NetBeez as a Controller

1.3 NetBeez as a Service Provider or Processor

When a customer uses NetBeez products to collect or process information from its networks, systems, employees, users, or devices, the customer generally determines the purposes and means of that processing. In those circumstances, NetBeez acts as a service provider or processor on behalf of the customer and processes the information according to the customer’s instructions, the applicable agreement, and any data processing addendum.

If your request concerns personal data processed by NetBeez on behalf of your employer or another NetBeez customer, you should generally submit the request directly to that organization. We will assist our customer in responding where required by applicable law and our agreement with the customer.

2. Personal Data We Collect

2.1 Information You Provide to Us

We may collect personal data that you provide directly, including:

  • Identity and contact information, such as your name, business email address, telephone number, postal address, country, and preferred contact method;
  • Professional information, such as your employer, job title, department, industry, and professional responsibilities;
  • Account information, such as your username, account identifier, organization, role, and account preferences;
  • Inquiry and sales information, such as the information you provide when requesting a demonstration, trial, quote, product information, or other assistance;
  • Customer and support information, such as support requests, diagnostic information, communications, attachments, and information about your use of NetBeez products;
  • Community and publication information, such as profile information and content that you choose to post in the NetBeez Community or another public area;
  • Marketing preferences, such as your subscription status and communication preferences;
  • Transaction and billing information, such as billing contacts, transaction details, purchase records, and limited payment information; and
  • Correspondence, including emails, chat messages, meeting information, survey responses, and other communications with NetBeez.

Please do not provide sensitive personal data unless it is specifically requested and necessary for the relevant purpose.

2.2 Information Collected Automatically

When you visit our website or use an online NetBeez service, we may automatically collect:

  • Internet Protocol address;
  • Browser type and version;
  • Device type and operating system;
  • Approximate geographic location derived from an IP address;
  • Referring and exit pages;

Depending on the product configuration selected by a customer, NetBeez products may process account information, device and network identifiers, IP addresses, network paths, Wi-Fi and network characteristics, test results, performance measurements, diagnostic information, logs, and other information configured or submitted by the customer.

NetBeez processes customer-controlled product data according to the applicable customer agreement and data processing addendum. Customers are responsible for determining what information they collect through the service and for providing required notices to their users.

2.4 Sources of Personal Data

We may receive personal data:

  • Directly from you;
  • From your employer or another organization with which you are associated;
  • Automatically from your browser, device, or use of our website and services;
  • From service providers that assist us with sales, marketing, analytics, security, payments, support, and website operations;
  • From business partners, resellers, event organizers, and referral sources; and
  • From publicly available professional and business sources.

3. How and Why We Use Personal Data

We may use personal data for the following purposes:

3.1 Providing Websites, Products, and Services

We use personal data to operate our website, create and administer accounts, provide products and services, deliver trials and demonstrations, authenticate users, provide documentation, and fulfill customer requests.

An unsubscribe request does not prevent us from sending transactional, security, support, billing, or other non-marketing communications.

We use transaction and billing information to process orders and payments, administer subscriptions, maintain financial records, and address billing questions.

The applicable legal basis may include performance of a contract, compliance with legal obligations, and our legitimate interest in administering our business.

3.11 Automated Decision-Making

4.1 Service Providers

  • Google, for Google Analytics 4, Google Ads, Google Tag Manager, and reCAPTCHA Enterprise;
  • Stripe and Intuit QuickBooks, for payment, billing, accounting, and transaction administration;
  • Cloud infrastructure and website hosting providers;
  • Email, support, conferencing, and business communications providers; and
  • Security, auditing, legal, insurance, and professional service providers.

Service providers may process personal data only for the purposes for which they have been engaged and subject to applicable contractual obligations.

4.2 Customers and Account Administrators

If you use NetBeez through an organization, authorized administrators for that organization may access account information and information associated with the organization’s use of the service.

4.3 Business Partners

We may disclose limited business contact and relationship information to authorized resellers, integration partners, event partners, or other business partners when necessary to fulfill a request or manage a business relationship.

4.4 Legal Requirements and Protection of Rights

NetBeez does not sell personal data in exchange for money.

When you consent to advertising technologies, we may disclose identifiers and internet or electronic activity information to advertising providers such as Google for advertising measurement and attribution. Some U.S. privacy laws may define this activity as “selling,” “sharing,” or processing for “targeted advertising,” even when no money is exchanged.

Where applicable, you may opt out by selecting “Decline” on our consent banner, reopening Cookie Settings through the website footer, or using a supported Global Privacy Control signal.

If you withdraw consent, the withdrawal does not affect processing that occurred before withdrawal. Your new choice will control future optional tracking. You may also use your browser settings to delete cookies that were created previously.

5.4 Global Privacy Control

Where supported, NetBeez recognizes Global Privacy Control signals through its consent-management system. We treat a recognized Global Privacy Control signal as a request to decline optional analytics and advertising technologies for that browser or device.

5.5 HubSpot

We use HubSpot for website forms, customer relationship management, communications, consent management, chat functionality, website analytics, and advertising attribution.

Depending on your choices and use of website features, HubSpot technologies may include consent cookies and identifiers such as __hs_opt_out, _hs_cookie_cat_pref, __hstc, __hssc, __hssrc, hubspotutk, messagesUtk, hs-messages-is-open, and related identifiers.

5.6 Google Analytics 4

Subject to your consent, we use Google Analytics 4 to understand website traffic, visitor interactions, and website performance. Google Analytics may use cookies and identifiers such as _ga, _ga_*, _gid, and related technologies.

5.8 Google Tag Manager

We use Google Tag Manager to manage Google Analytics and Google Ads tags. Google Tag Manager and the optional tags it controls are not loaded unless you accept optional technologies.

5.9 Google reCAPTCHA Enterprise

We use Google reCAPTCHA Enterprise on certain forms to detect and prevent fraud, spam, and abuse.

In providing this security service, Google may collect device, browser, network, IP address, software, and interaction information and process that information for security, fraud prevention, and operation of reCAPTCHA. Google states that information collected through reCAPTCHA Enterprise is not used for personalized advertising.

Because reCAPTCHA is used for website and form security, it may load when a protected form is displayed regardless of your optional analytics and advertising choice.

5.10 NetBeez Community

The NetBeez Community may use cookies such as _forum_session and _t for authentication, login status, session management, and security.

5.11 Browser Controls

Most browsers allow you to block or delete cookies. Blocking all cookies may prevent certain website features from functioning properly.

You may unsubscribe from NetBeez marketing communications at any time by:

  • Selecting the unsubscribe or communication-preferences link included in a NetBeez marketing email; or
  • Contacting us at info@netbeez.net.

We may retain limited information about an unsubscribe request so that we can honor the request in the future.

Submitting a demonstration, trial, contact, or support request permits NetBeez to respond to that request. Any additional marketing use will be handled in accordance with applicable law and the privacy choices presented with the relevant form.

An unsubscribe request does not prevent us from sending transactional, security, support, billing, or other non-marketing communications.

7. International Transfers

NetBeez is based in the United States. Personal data may be processed in the United States and other countries where NetBeez, its customers, or its service providers operate.

Those countries may have privacy laws that differ from the laws in your country. Where required, we use appropriate safeguards for international transfers, which may include contractual protections, data processing agreements, the European Commission’s Standard Contractual Clauses, the United Kingdom’s approved transfer mechanisms, or another legally recognized transfer mechanism.

For customer-controlled product data, the applicable customer agreement or data processing addendum may provide additional information about data locations and transfer safeguards.

8. Data Retention

We retain personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing services, maintaining business and customer relationships, honoring privacy choices, complying with legal and accounting obligations, resolving disputes, and enforcing agreements.

The retention period depends on factors such as:

  • The nature and sensitivity of the information;
  • The reason it was collected;
  • Whether an account or business relationship remains active;
  • Contractual commitments;
  • Applicable limitation periods;
  • Tax, accounting, employment, security, and other legal requirements;
  • The need to establish or defend legal claims; and
  • Whether the information can be deleted or anonymized.

Marketing contact information may be retained while you remain subscribed. If you unsubscribe, we may retain a limited suppression record to ensure that we continue to honor your preference.

Cookie and analytics information is retained according to the applicable cookie duration, our configuration, and the service provider’s retention settings. Individual technologies may persist from the duration of a browser session to a longer period unless deleted earlier.

Customer-controlled product data is retained according to the customer’s configuration, the applicable agreement, and NetBeez’s data retention and deletion procedures.

When personal data is no longer required, we will delete, anonymize, or securely isolate it, subject to applicable legal and technical requirements.

9. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure.

No internet transmission, information system, or storage method is completely secure. We therefore cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of account credentials and for notifying NetBeez if you suspect unauthorized access to an account.

10. Your Privacy Rights

Depending on your location and applicable law, you may have the right to:

  • Request access to personal data we maintain about you;
  • Request correction of inaccurate personal data;
  • Request deletion of personal data;
  • Request restriction of processing;
  • Object to certain processing;

Withdrawal of consent does not affect the lawfulness of processing performed before withdrawal.

We may need to verify your identity before fulfilling a request. An authorized agent may submit a request where permitted by law, but we may request evidence of the agent’s authority and may verify the request directly with you.

Payment providers may process payment-card or financial-account information. NetBeez generally does not receive complete payment-card credentials.

We do not use sensitive personal information to infer characteristics about individuals.

11.2 Sources and Purposes

The sources of personal information are described in Section 2.4. The business and commercial purposes for collecting and using it are described in Section 3.

11.3 Disclosures for Business Purposes

We may disclose identifiers, business contact information, commercial information, internet activity information, approximate location, and account or service information to service providers and other recipients described in Section 4.

11.4 Sale, Sharing, and Targeted Advertising

NetBeez does not sell personal information for money.

After a visitor accepts advertising technologies, NetBeez may disclose identifiers and internet activity information to Google for advertising measurement and attribution. Applicable state law may define this activity as sale, sharing, or targeted advertising.

You may opt out by:

  • Selecting “Decline” on the website consent banner;
  • Selecting “Cookie Settings” in the website footer and changing your choice;
  • Using a supported Global Privacy Control signal; or

NetBeez does not knowingly sell or share the personal information of individuals under 16 years of age.

12. European Economic Area, United Kingdom, and Switzerland

If you are located in the European Economic Area, United Kingdom, or Switzerland, applicable law may provide rights to access, correct, delete, restrict, object to, or obtain a portable copy of your personal data, and to withdraw consent.

Where we rely on legitimate interests, those interests include operating and securing our business and services, responding to business requests, managing customer and professional relationships, improving services, preventing fraud, and protecting legal rights. We consider the potential effects on individual rights before relying on legitimate interests.

Where processing is necessary to fulfill a contract or take requested pre-contractual steps, failure to provide required information may prevent us from providing the requested product or service.

You may lodge a complaint with the data protection authority in the country where you live, work, or believe an infringement occurred. We encourage you to contact NetBeez first so that we can attempt to address the concern.

13. Children’s Privacy

NetBeez websites and services are intended for business and professional users and are not directed to children.

We do not knowingly collect personal data from children under 13 through our public website. If you believe that a child has provided personal data to NetBeez, contact us so that we can investigate and take appropriate action.

14. Third-Party Websites
